By accessing or using this Site, placing an order, or entering any promotion we run, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Site.

1. Use of This Site

You must be 18 years of age or older to purchase alcohol or enter any promotion on this Site, in accordance with responsible service of alcohol laws.
You agree to provide accurate, current, and complete information when creating an account, placing an order, or entering a promotion.
You must not use the Site for any unlawful purpose, or in any way that could damage, disable, or impair the Site or interfere with any other party's use of it.

2. Products and Orders

All product descriptions, pricing, and availability are subject to change without notice.
We reserve the right to refuse or cancel any order, including where a product is listed at an incorrect price, stock is unavailable, or we suspect fraudulent activity.
Orders are subject to age verification. We reserve the right to request proof of age at the point of delivery, and to refuse delivery where this cannot be confirmed.
Prices are listed in AUD and include GST unless otherwise stated.

3. Delivery

Delivery timeframes provided at checkout are estimates only and are not guaranteed.
Alcohol will only be delivered to, and signed for by, a person aged 18 years or older.
We are not liable for delays caused by circumstances outside our reasonable control, including courier delays, incorrect address details provided by the customer, or force majeure events.

4. Returns and Refunds

Returns and refunds are handled in accordance with the Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you under the Competition and Consumer Act 2010 (Cth) that cannot lawfully be excluded.
For faulty, damaged, or incorrect items, please contact us at info@thebenbuckler.com within 7 days of delivery.

5. Intellectual Property

All content on this Site, including text, graphics, logos, images, and the "The Ben Buckler" name and branding, is the property of The Ben Buckler Whisky Company Pty Ltd or its licensors and is protected by Australian and international intellectual property laws. You may not reproduce, distribute, or use this content without our prior written consent.

6. Limitation of Liability

To the extent permitted by law, The Ben Buckler is not liable for any indirect, incidental, or consequential loss arising from your use of the Site or participation in any promotion, except where such liability cannot be excluded under the Australian Consumer Law.

7. Privacy

Your use of this Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

8. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales.

9. Changes to These Terms

We may update these Terms and Conditions from time to time. Continued use of the Site following any changes constitutes acceptance of the updated Terms.

Promotion-Specific Terms

The following sections apply in addition to the General Terms and Conditions above and govern specific promotions run by The Ben Buckler. Where there is any inconsistency between these promotion-specific terms and the General Terms and Conditions, these promotion-specific terms prevail in relation to that promotion only.

Father's Day Free Cap & Jerky Promotion

Promoter: The Ben Buckler Whisky Company Pty Ltd (ACN 688 876 593), 40 Lime Street, Sydney NSW 2000.
Promotion Period: This offer runs from Thursday, 6 August 2026 until Father's Day 2026 (Sunday, 6 September 2026), or while stocks of the free gift items last, whichever occurs first ("Promotion Period").
How It Works:

Purchase one (1) 700ml bottle of The Ben Buckler Whisky during the Promotion Period to receive one (1) complimentary limited edition Ben Buckler trucker cap.
Purchase two (2) 700ml bottles of The Ben Buckler Whisky during the Promotion Period to receive one (1) complimentary limited edition Ben Buckler trucker cap and complimentary Ben Buckler jerky.

Eligibility: Open to customers aged 18 years or older purchasing via www.thebenbuckler.com and having their order delivered within Australia.
Free Gift Availability: Free gift items (caps and jerky) are offered while stocks last. If a free gift item becomes unavailable, the Promoter reserves the right to substitute it with an item of equal or greater value, or to notify the customer that the relevant free gift is no longer available.
Limitations: This offer applies per-order and cannot be combined with certain other promotional codes unless expressly stated. The Promoter reserves the right to limit the number of free gifts per customer at its discretion to prevent misuse.
Non-Transferable: The free gift items are not redeemable for cash and cannot be exchanged for an alternative product.
General: The Promoter reserves the right to amend, suspend, or end this promotion at any time, subject to applicable law. This is not a game of chance and does not require a trade promotion permit.

Father's Day Mega Manper Giveaway Competition

Promoter: The Ben Buckler Whisky Company Pty Ltd (ACN 688 876 593), 40 Lime Street, Sydney NSW 2000 ("Promoter").

Promotion Period: The competition commences at 12:00am AEST on Monday, 17 August 2026 and closes at 11:59pm AEST on Monday, 31 August 2026 ("Promotion Period"). Entries received outside the Promotion Period will not be accepted.

Eligibility: Entry is open to Australian residents aged 18 years or older, excluding residents of Western Australia. Employees, contractors, directors, management, immediate family members, and agencies associated with the Promoter (and, in respect of the Grand Prize accommodation component, 25hours Hotel The Olympia) are ineligible. The Promoter reserves the right to verify the age, identity, and eligibility of entrants.

How to Enter: Entry is free. To enter, eligible entrants must, during the Promotion Period, complete the official entry form through the Ben Buckler Meta Ads Instant Form or at thebenbuckler.com/pages/fathersday, providing:

A response of 50 words or less nominating "the legend in your life" and the reason for the nomination;

Full name, email address, and phone number;

Confirmation of agreement to these Terms and Conditions and the Promoter's Privacy Policy.

No purchase is necessary to enter this competition.

Nature of Competition: This is a game of skill. Winners will be selected based on the creativity, originality, and merit of their nomination entry, as judged by The Ben Buckler team, whose decision is final and no correspondence will be entered into.

Prizes: There are six (6) prizes to be won:

Five (5) Minor Prizes: One (1) bottle of The Ben Buckler Whisky each, awarded to five (5) entrants across the Promotion Period (see Judging and Winner Notification below for dates).

One (1) Grand Prize: The Ben Buckler "Mega Manper" hamper, comprising:

One (1) night's accommodation, dinner, and a cocktail voucher at 25hours Hotel The Olympia, Sydney, valued at $1,200;
Three (3) x 700ml bottles of The Ben Buckler Whisky, valued at $285;
Three (3) x 200ml bottles of The Ben Buckler Whisky, valued at $105;
Three (3) x 50ml bottles of The Ben Buckler Whisky, valued at $30;
One (1) Tactix heavy duty tool box, valued at $85;
Ten (10) packets of The Ben Buckler Whisky-Infused Jerky, valued at $120;
One (1) Ben Buckler t-shirt, valued at $50;
Two (2) Ben Buckler Trucker Caps, valued at $60;
One (1) pair of Ben Buckler boxer shorts, valued at $30;
One (1) Ben Buckler pottery flask, valued at $50;
One (1) Ben Buckler candle, valued at $40;
One (1) BCF gift voucher, valued at $100;
One (1) Bunnings gift voucher, valued at $100; and
Mixed chocolates, valued at $45.

Total Grand Prize value: AUD $2,300 (including GST).

Prize inclusions are subject to availability. Prizes are not transferable, exchangeable, or redeemable for cash, in whole or in part. If any element of a prize becomes unavailable, the Promoter reserves the right to substitute that element with an item or experience of equal or greater value. The accommodation component of the Grand Prize is provided by, and subject to the booking terms, availability, and any blackout dates of, 25hours Hotel The Olympia, and must be redeemed within the timeframe communicated to the winner at the time of prize notification.

Judging and Winner Notification:

Minor Prizes: One (1) Minor Prize winner will be judged and notified on each of the following dates: Wednesday 19 August, Friday 21 August, Monday 24 August, Wednesday 26 August, and Friday 28 August 2026, each drawn from eligible entries received up to that date.

Grand Prize: The Grand Prize winner will be judged from all eligible entries received during the Promotion Period and notified on Tuesday, 1 September 2026, allowing sufficient time for prize fulfilment ahead of Father's Day (Sunday, 6 September 2026).

Winners will be notified by phone and/or email. If a winner cannot be contacted, or does not respond within 2 business days of notification, the Promoter reserves the right to select an alternative winner from the remaining eligible entries, to ensure prizes can still be dispatched in time for Father's Day.

Third-Party Nominations: Entrants must only submit nomination content they have the right to share, and must not include any private, sensitive, or defamatory information about the nominated individual. By entering, entrants confirm the nominated individual would be comfortable with the nomination being shared publicly, where the Promoter elects to showcase entries as part of the promotion.

Publicity: By accepting a prize, the winner(s) agree to participate in reasonable promotional activity associated with the competition, including photography and social media content, without additional compensation, unless prohibited by law.

Verification and Disqualification: The Promoter reserves the right to verify the validity of entries and to disqualify any entrant who tampers with the entry process, submits an invalid, offensive, or plagiarised entry, breaches these Terms and Conditions, or engages in unlawful or improper conduct.

Liability: To the extent permitted by law, the Promoter is not responsible for technical failures or website interruptions, lost, delayed, incomplete, or misdirected entries, inaccuracies in entrant information, or circumstances beyond its reasonable control affecting prize fulfilment. Nothing in these Terms and Conditions excludes rights under the Competition and Consumer Act 2010 (Cth).

Privacy: Personal information collected will be used for the purpose of administering this promotion, and in accordance with the Promoter's Privacy Policy. By entering, entrants consent to the Promoter collecting and using their personal information for these purposes, including the nomination content submitted.

Responsible Consumption: Entry is strictly limited to persons aged 18 years or older. By entering, entrants confirm they are of legal drinking age in their state or territory. Drink responsibly.

General: The Promoter reserves the right, subject to applicable law, to cancel, suspend, modify, extend, or terminate the competition if circumstances beyond its reasonable control affect its proper administration. Participation constitutes full acceptance of these Terms and Conditions.
